Terms and Conditions of Service for Customers:

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures. By registering at or merely browsing on Our Site, You have agreed to be bound by all of these Terms and Conditions of Service for use and access of the Site.

PLEASE ENSURE THAT YOU READ AND UNDERSTAND ALL THESE TERMS AND CONDITIONS BEFORE YOU USE ANY OF THE SERVICES OFFERED ON THE SITE, BECAUSE YOU SHALL BE BOUND BY ALL THE TERMS AND CONDITIONS CONTAINED HEREIN.

If You do not accept any of the Terms and Conditions, then please don’t use the Mobile App or avail any of the Services being provided therein.

YOU AGREEING TO THESE TERMS AND CONDITIONS SHALL OPERATE AS A BINIDNG AGREEMENT BETWEEN YOU AND EASY SEVA IN RESPECT OF THE SERVICES OFFERED/AVAILED USING THE MOBILE APP.

Highlights

Easy Seva only connects Service Provider who are looking for an opportunity to nearby Authorised Registered Users. Easy Seva does not represent any and is not responsible for their behavior or actions.
Seva does not vouch for the veracity of the information provided by the Service Provider. The User is solely responsible for verifying the information provided by any Service Provider they hire.
Easy Seva does not control or influence service charges charged by the Service Providers. The Service Provider’s charges must be agreed between the Service Provider and the User during their meeting/call/communication/talks.
The User is solely responsible conducting their own verification before or after hiring a Service Provider through Easy Seva.

Introduction

This APP is owned and operated by USR Techlinks Pvt Ltd.(hereinafter referred to as “Easy Seva”). These are the Terms & Conditions (“T&Cs”) under which you may use “www.easyseva.in” (the “Mobile APP”).
By using the Mobile App and the available services, you indicate your agreement to these T&Cs, including Privacy Policy. Please read this page carefully. If you do not accept the T&Cs stated here, do not use the Mobile App. Since the T&Cs may change over time and without any advance notification you should also occasionally visit this page to review any modifications to the T&Cs because they are binding on you.

FOR USERS

Easy Seva’s Liability

Easy Seva’s Mobile App provides an online Information, intended to act as a market place for “Service Providers” and individual or company “Users” using the Mobile APP.
The Mobile App is a Public App with free access and Easy Seva assumes no liability for the quality and genuineness of Service Provider profiles and other information contained on the Mobile App.
Easy Seva is not responsible for the veracity or accuracy of the information contained in the Service Provider profiles showcased on the Mobile App.
You should conduct your own background checks on the bonafide nature of the information contained in any Service Provider profiles (s).
Easy Seva shall in no way be held liable for any information received by the User and it shall be the sole responsibility of the User to check, authenticate and verify the information / response received at their own cost and expense.
Easy Seva has no obligation to screen or censor any of the Mobile Apps’ content, nor is Easy Seva responsible for the actual transaction between Users and Service Providers.
Thus, Easy Seva has no control over the quality or legality of the works, or Service Provider profile, posted.
Easy Seva makes no representations about the truthfulness of Service Provider information or Service Provider content on the Mobile App and encourages all Users to conduct their own investigation as to a Service Provider’s suitability for contract and trustworthiness.
The information provided on this Mobile App is only for reference purposes.
Easy Seva’s Mobile App may contain inaccuracies or typographical errors.
Easy Seva makes no representations about the accuracy or completeness of any Mobile App or its content.
Please note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, underage persons or people who may misrepresent themselves on the Mobile App.
When you use our Mobile App you assume all risks associated with dealing with Service Providers with whom you come in contact through our Mobile Apps.
By its very nature, other people’s information may be offensive, harmful, inaccurate, or untrue. Please be careful when using our Mobile App.
Easy Seva does not warrant that each Service Provider is who they claim to be.
Since Easy Seva is not, and cannot be involved in User-to-Service Provider dealings or control the behavior of the participants on any Mobile App, in the event that you have a dispute with one or more users, you release Easy Seva(and our agents and employees) from claims and damages (whether actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
That any usage of this Mobile App does not guarantee the provision/creation of any job to/for a Service Provider.
Easy Seva is not to be considered an User and shall not be responsible for any employment decisions, for whatever reason made, by any entity recruiting for any jobs on this Mobile App.
Easy Seva cannot guarantee that any Service Provider will be exactly what any User wants or that the Service Provider will perform as required.
No advice or information obtained by a user from the Mobile App shall create any warranty whatsoever.
You also represent and warrant to Easy Seva that you will use the Mobile Apps in a manner consistent with any and all applicable laws and regulations.
Easy Seva in no way either represents or guarantees the accuracy, reliability or the truthfulness of any content on the Mobile App.
You hereby acknowledge that any dependence placed upon the content on the Mobile App is done entirely at your own risk.

Permitted Use of our Mobile App(s)

You have the following rights to the Mobile App(s):

1.To search for Service Providers based on your requirements.

All content is the property of Easy Seva, and all content is protected by applicable trademark laws.

2. You are not allowed to sell or modify the Mobile Apps’ content for any public or commercial use.

In case of any violation, Easy Seva shall have the right to take any action permitted under law.
The use of the Mobile Apps’ content on any other web Mobile App or in a networked computer environment for any purpose is also expressly prohibited.

Prohibited Use of our Mobile App(s)

Users warrant to only utilise the Mobile Apps in accordance with these Terms & Conditions and any relevant statutory provisions.
The user undertakes to use the Mobile App for his/her own purposes. Using content from the Mobile App for derivative works with a commercial motive without prior written consent from Easy Seva is strictly prohibited.
Easy Seva uses technological means to exclude Robots etc from crawling the webMobile App and scraping content.
The user undertakes not to circumvent these methods.
Users shall not spam the database maintained by Easy Sevaor indiscriminately and repeatedly forward mail that may be considered spam etc. etc.
Any conduct of the user in violation of this clause shall entitle Easy Seva to forthwith terminate all services to the user without notice and to forfeit any amounts paid by him.
Users undertake that the services offered by the Mobile App / Easy Seva shall not be utilized to upload, post, email, transmit or otherwise make available either directly or indirectly, any unsolicited bulk e-mail or unsolicited commercial e-mail.
Easy Seva reserves the right to filter and monitor and block the emails sent by you/user using the servers maintained by Easy Seva to relay emails.
All attempts shall be made by Easy Seva and the user to abide by International Best Practices in containing and eliminating Spam.
Users are prohibited from violating the security of any Mobile App by engaging in the following:
- (a) accessing data not intended for such user or logging into an account which the user is not authorized to access;
- (b) attempting to test the vulnerability of a system or to breach any security or authentication measures; or
- (c) attempting to overload, spam, or crash any Mobile App by means of a “virus” or other software “attack” upon the Mobile Apps’ integrity.
Any attempted Mobile App violations may result in civil or criminal liability, and Easy Seva will prosecute users who are involved in such violations.
Users may not use any Mobile Apps in order to transmit, or store material
- (a) in violation of any applicable law or regulation,
- (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others,
- (c) that is defamatory, obscene, threatening, abusive or hateful, or
- (d) in a manner which jeopardizes India’s national security, contributes to social unrest, or sectarian violence.
All users agree not to engage in any activity which seeks to take advantage of or exploit other users of the Mobile Apps, or of the Mobile Apps themselves.
This prohibited behavior includes, but is not limited to, the following:
- (a) offering business or sales opportunities;
- (b) offering jobs from competitors of the Easy Seva,
- (c) posting any inaccurate or misleading content on the Mobile Apps;
- (d) sending any unsolicited offer to Mobile App users;
- (e) deleting any content or posting of other users;
- (f) engaging in any behavior which has the effect of degrading the performance of the Mobile Apps;
- (g) reverse engineering any portion of the Mobile Apps;
- (h) using or inserting a personal or corporate URL, web link, or email address, into any portion of the Mobile Apps (except where specifically requested by the Mobile Apps) and (i) duplicating, posting, or linking any Mobile App content to other Mobile Apps not belonging to Easy Seva.
Users may not use the Mobile App(s) to transfer any money in violation of any applicable law or regulation.

Prohibited Content on Our Mobile Apps

Any content which is offensive, dangerous, invades the privacy of others or is unlawful is prohibited from the Mobile Apps:

This includes, but is not limited to, the following:

(a) pornography;
(b) solicitation of illegal activities;
(c) racial, religious, or ethnic slurs
(d) incitement to violence against any individual for whatever reason;
(e) the sending of junk mail or spam;
(f) violating or advocating the violation of copyrighted works;
(g) releasing private information of another user without their consent; and
(h) providing information or instruction about illegal activities.

Violation of Terms of Use and Threatening Behavior

Although Easy Sevais not responsible for screening or monitoring user content, Easy Sevamay review and delete any content that violates these Terms of Use, violates applicable law, rule or regulation, is offensive or illegal, violates the copyrights of another or violates the rights of, harms or threatens the safety of users of Easy Seva’s Mobile Apps.
If you engage in prohibited behavior you risk expulsion from the Mobile Apps, and future restrictions may be placed upon your continued access to the Mobile Apps.
If appropriate, legal action may be instituted against you.
Easy Seva will also remove your content from the Mobile Apps.
In no event shall Easy Seva, its affiliates, or its supplier’s suppliers, or any third parties mentioned on any of Easy Seva’s Mobile App be liable for any damages whatsoever (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data or business interruption) resulting from the use or inability to use any of Easy Seva’s Mobile Apps and content, whether based on warranty, contract, tort, or any other legal theory, and whether or not Easy Sevais advised of the possibility of such damages.
Further, the entire liability of Easy Seva, and your sole and exclusive remedy, for any claim or cause of action arising hereunder (whether in contract, tort, or otherwise) shall not exceed the lesser of the registration fees paid.

General

The T&Cs constitute the entire agreement between you and Easy Seva and govern your use of the Service.

The T&Cs and the relationship between you and Easy Seva shall be governed by the laws of the country of India without regard to its conflict of law provisions and courts at Hyderabad alone shall have the exclusive jurisdiction to try and entertain any dispute arising out between you and the Easy Seva.

The failure of Easy Seva to exercise or enforce any right or provision of the T&Cs shall not constitute a waiver of such right or provision.

If any provision of the T&Cs is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the T&Cs remain in full force and effect.

Refund

Subscription once taken cannot be cancelled. Hence, any amount paid is non-refundable.

Disclaimer of Warranty

Easy Seva does not warrant that our Mobile Apps will operate error-free or that our Mobile Apps are free of computer viruses or other harmful mechanisms.

If your use of any Mobile Apps or Mobile Apps’ content results in the need for servicing or replacing equipment or data, Easy Seva is not responsible for those costs.

The Mobile Apps are provided on an "as is" basis without any warranties of any kind.

Easy Seva, to the fullest extent permitted by law, disclaims all warranties, whether express or implied, including the warranty of merchantability, fitness for particular purpose and non-infringement.

Indemnity

You agree to indemnify and hold Easy Seva, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, harmless from any claim or demand, including reasonable attorney fees and court costs, made by any third party due to or arising out of content you submit, post or make available through the Mobile App or your use thereof, your violation of the T&Cs, your breach of any of the representations and warranties herein or your violation of any rights of another.

FOR SERVICE PROVIDERS

The following terms and conditions are applicable upon all members of the general public and businesses within India (collectively herein after referred to as ‘Service Providers’) who have voluntarily evinced interest in having their own profile with Easy Seva (hereinafter referred to as “Easy Seva”) by creation of a ‘Service Provider Profile’.

The Service Provider Profile for the Service Provider that will be created by Easy Seva, will be shared openly on Easyseva.in and partner web Mobile Apps with the interested individuals and businesses (collectively herein after referred to as ‘Users) who are availing the recruitment services/related services (collectively herein after referred to as ‘Services’) of Easy Seva in India or abroad.

It is hereby clarified by Easy Seva that the Services being rendered by Easy Seva to the Users are in the nature of providing information about the related services; in course of which Easy Seva is required to provide details and information of prospective candidates to the Users based upon their specific requirements (skill/qualification based or on other parameters).

Basis the above need, Easy Seva is creating a database of Service Provider Profiles (using proprietary technology of Easy Seva) of Service Providers wherein the Service Provider voluntarily provides his/her information/details/ personally identifiable data with Easy Seva for the creation of the Service Provider Profile.

All Service Provider Profiles created by Easy Seva are subject to the following terms and conditions that compulsorily are applicable upon the Service Providers who have permitted their respective Service Provider Profiles to be created by Easy Seva.

Voluntary Disclosure

The Service Provider confirms, agrees and acknowledges that he/she is providing their information/details/personally identifiable data with Easy Seva for the creation of the Service Provider Profile voluntarily.

The Service Provider also confirms and acknowledges that they have been disclosed the purpose of the submission of the information/data and accordingly agree/consent to the terms and conditions applicable upon the Service Provider as stipulated by Easy Seva from time to time.

You acknowledge and warrant that Easy Seva has not instigated and/ or forced you to deposit money in the Easy Seva account in return of job guarantee or assured placement.

Veracity of Information

The Service Provider hereby confirms, agrees and acknowledges that he/she has provided true and correct information/details/ personally identifiable data to Easy Sevafor the creation of their Service Provider Profile.

The Service Provider acknowledges that the information/ data being provided by the Service Provider to Easy Seva is correct, complete and updated in all respects at all times and does not contain any false, distorted, manipulated, fraudulent or misleading facts or averments.

Easy Seva will not be liable for any misrepresentation/incorrect facts, etc. that are provided by the Service Provider and each Service Provider shall be entirely responsible & liable for the veracity of the information shared with Easy Seva for the creation of the Service Provider Profile.

The Service Provider acknowledges the fact that Easy Seva will reply upon the information / data provided (by the Service Providers to Easy Seva) and accordingly share the information on the Service Provider(s) with interested Users.

The Service Provider(s) agree(s) to bear the sole risk and responsibility for the information provided including the veracity and accuracy thereof and also agree(s) to indemnify Easy Seva for all losses incurred by Easy Seva due to any false, distorted, manipulated, fraudulent or misleading facts given by Service Provider(s) to Easy Seva.

Continuing Acceptance of terms and conditions

The Service Provider acknowledges that by sharing, his/her information/data; he/she has voluntarily accepted the terms and conditions applicable upon the Service Provider from time to time including future version thereof, for which Easy Seva will not be responsible or liable (in any manner) to intimate the Service Provider of the changes in the terms and conditions (at any point in time).

Waiver of Rights

The Service Provider hereby confirms that by creation of the Service Provider Profile, the Service Provider has granted the right to Easy Seva (to the exclusion / waiver of the individual Service Provider’s rights) to

(i) provide/share the information of the Service Provider to/with the prospective Users on a repeated basis without seeking Service Provider’s consent each time,
(ii) make calls/send SMS’s to the Service Provider pursuant which shall not constitute unsolicited commercial communications/calls/SMS under the Telecom Regulatory Authority of India (TRAI) regulations and/or any such applicable law,
(iii) send e-mails to the Service Provider pursuant to any job-related information or otherwise
(iv) use the information of the Service Provider profiles for offering value-added services to the Service Provider as well as related marketing/business activities determined by Easy Seva at its sole discretion,
(v) share information of any/all Service Providers with 3rd parties for purposes including but not limited to background, skill development courses to Service Providers, etc.

Grant of Permission

By creation of the Service Provider Profile, the Service Provider confirms that Easy Seva has the right to assess Service Provider(s) eligibility/fitness for any particular job(s) based on Easy Seva’s proprietary methodology.

Further, basis such assessment, Easy Seva has the right to infer capabilities and skills of the Service Provider(s) vis-a-vis score the Service Provider(s) for a fit as regards any particular job(s) on a best effort basis.

The Service Provider(s) shall at no time have any right to question and/or dispute the manner & methodology of Easy Seva in this regard.

Easy Seva also has the right to revise/adjust scores based on Easy Seva’s internal methodology which would be based on the background, skills, preferences and other related information disclosed by the Service Provider(s).

For illustration, a Service Provider could face a revision of scores due to “no shows” for interviews or incorrect information given in the preparation of the Service Provider Profile.

The Service Provider(s) unequivocally agree to the manner/method for the scoring adopted by Easy Seva without any protest/dispute towards the same.

The Service Provider will not hold Easy Seva liable for any such assessment and/or consequent score provided to client of Easy Seva/ the prospective User by Easy Seva.

Disclaimer & Limitation of Liability

The Service Provider understand(s) and acknowledge(s) that creation of Service Provider Profile or any such assessment by Easy Seva of the Service Provider does not constitute an “interview” for any employment opportunities nor does the Service Provider Profile assure/guarantee/promise (in any manner whatsoever) prospective employment to each/any Service Provider.

Service Provider also understand(s) and acknowledge(s) that while offering such Services, Easy Seva is merely acting as an intermediary/facilitator between the Service Provider and the User/ prospective User.

By doing so, Easy Seva does cannot assure/guarantee the Service Provider of any assured employment or any other aspect with regards the prospective employment including but not limited to description of employment, designation, grant of benefits, quality work environment, etc.

No Service Provider shall hold Easy Seva responsible and/or liable in the event Service Provider is not shortlisted for and/or fails to receive any employment opportunities and/or any response/satisfactory response from any prospective User, pursuant to availing the recruitment services of Easy Seva.

No Service Provider can hold Easy Seva responsible for any actions/omissions that may occur inadvertently and/or due to human error and/or on the part of any prospective User(s).

Continued Applicability

By creation of the Service Provider Profile, the Service Provider confirms that Easy Seva will keep and regard the Smart Profile(s) to continue within the Easy Seva Service Providers database until the particular Service Provider contacts Easy Seva for the removal of the Service Provider Profile in writing. Furthermore, Easy Seva is not under any obligation to validate, update or revalidate the contents of the Service Provider Profile of any Service Provider and it is the obligation of the Service Provider to voluntarily update his/her Service Provider Profile with Easy Seva.

Also, these terms and conditions (as applicable from time to time) continue to be applicable to all Service Providers until such time that the Service Provider contacts Easy Seva for the removal of the Service Provider Profile in writing.

The Service Provider, by getting the Service Provider Profile done through Easy Seva, also agrees that the Service Provider Profile forms a part of Easy Seva’s proprietary database which can be shared with Easy Seva’s prospective clients or any Users at any point of time.

Easy Seva cannot be held liable for sharing of any data with clients or other unrelated 3rd parties, if the Service Provider does not voluntarily remove their Smart Profile from Easy Seva’s proprietary database.

Dispute Resolution and Jurisdiction

All disputes/differences of any Service Providers with regards Easy Seva and/or the Services, shall be subject to the laws of the Republic of India and the exclusive jurisdiction of the courts at Hyderabad only.
